Cash Sweepstakes Official Rules & Regulations

The Palliative Care Center at Sundale and Sundale Nursing Home Present

The 2009 "Cash Sweepstakes" Official Rules & Regulations 


1.        Monongalia Home Corporation d/b/a Sundale Nursing Home (SNH) is conducting a raffle with the grand prize being $20,000 (twenty thousand dollars). The price per ticket is $20.00, which shall be payable in cash, check or money order. Checks and money orders shall be made payable to: Sundale Sweepstakes. Tickets will be available at the following: 1) volunteer ticket distributors, 2) the receptionist's desk in the main lobby of Sundale Nursing Home, 3) our kiosk location at the Morgantown Mall, and 4) additional locations listed at www.sundalecare.com . Credit card orders may be placed on the website of the Greater Morgantown Community Trust at www.gmctfoundation.org . Purchasers of tickets online will be mailed a copy of their ticket stub for verification within two business days following the purchase date. The purpose of this raffle is to raise funds for the architectural expenses associated with the construction of a 15 private room addition to the existing building located at 800 J. D. Anderson Drive, Morgantown, WV to be called The Palliative Care Center at Sundale. In addition to the Grand Prize, there will be 49 other cash prizes which will be listed on the ticket. In consideration of the opportunity to purchase raffle tickets, any purchaser shall be bound by the terms of these rules which shall constitute a binding contract between the purchaser and Sundale Nursing Home. Special attention should be given to Paragraph 8 of this document which provides for the circumstances in which Sundale Nursing Home has the right to withdraw the $20,000 Grand Prize and instead substitute a 50/50 drawing further described in paragraph 8. Paragraph 8 also provides for the modification of Cash Prizes based on the percentage of tickets sold of the maximum 10,000 tickets available for sale.

 

2.        All ticket stubs shall be collected in order received from volunteer ticket distributors of Sundale Nursing Home and placed in the official ticket drawing cage. Checks will be deposited upon receipt. Checks that are returned for insufficient funds or other reasons will disqualify the ticket covered by such check and the ticket will be voided at the time of the drawing.

 

3.        All tickets purchased by check must be purchased by 5:00pm, Wednesday, December 16, 2009. Cash and money order sales will continue until the maximum number have been sold or 15 minutes prior to the drawing, whichever occurs first.

 

4.        The maximum number of tickets that will be sold is 10,000. Ticket sales will cease when that number is reached. With 50 total prizes offered, the odds of winning are approximately 1 in 200. Prize awards are subject to the conditions stated below. The drawing for the $20,000 Grand Prize and other cash prizes will be held on December 21, 2009 at approximately 1:00 pm at center court of the Morgantown Mall in Morgantown, WV. The exact time of the drawing is subject to change. In the event of circumstances beyond our control, such as an act of nature, the drawing will be rescheduled and publicly announced.

 

5.        All prizes are subject to, and the winners are fully responsible for, any federal and state taxes. Sundale Nursing Home has no responsibility for the payment of any taxes associated with the prizes (except for the responsibility to comply with the withholding regulations and requirements of the taxing authorities involved).

 

6.        Winner of the Grand Prize, as well as other cash prizes in excess of $100, will be notified by mail and must present proper identification, current address and social security number for federal income tax withholding purposes. All other cash prizes will be mailed within 10 business days of the drawing to winner's address recorded on the ticket.

 

7.        SNH is required to withhold and remit 28% (25% if Sundale is furnished with the recipient's social security number and home address) of the fair market value of the Grand Prize to the Internal Revenue Service for prizes in excess of $5,000.

 

8.        In the event that at least 4000 tickets have not been purchased by 5:00pm on December 17, 2009, SNH reserves the right to cancel  the above listed Grand Prize and conduct a 50/50 drawing.  The Grand Prize winner, in such event, will receive 50% of the total proceeds of the raffle net of expenses. Additionally, in the event the overall number of tickets sold falls short of the 10,000 goal, SNH reserves the right to modify all "Other Cash Prizes" to reflect the percentage of tickets actually sold as of 5:00 pm on December 17, 2009. (e.g. if 7,500 tickets (75%) are sold as of December 17, 2009, the second place winner will receive $3,750 (75% of the listed $5,000) prize, the third place winner will receive $3,000 (75% of the listed $4,000 prize), and so on).The decision to modify the cash prizes shall be made, and announced publicly, prior to the drawing on Friday December 18, 2009.

 

9.        Monongalia Home Corporation d/b/a Sundale Nursing Home is a 501(c)(3), non-stock, not-for-profit corporation. Net proceeds will benefit The Palliative Care Center at Sundale. The $20 ticket price is not deductible for income tax purposes as a charitable donation.

 

10.     Winner(s) need not be present to win nor be a resident of West Virginia. Participants must be 18 years or older to purchase a raffle ticket and raffle tickets must be in the name of a person 18 years of age or older.

 

11.     Raffle workers and operators as defined in 110 CSR 37– 3.1.5 ARE INELIGIBLE to participate in the raffle game. Spouses and immediate family members of raffle workers and operators ARE ELIGIBLE to participate in the raffle game.

 

12.     The winner consents to the use of their name and likeness for advertising/publicity purposes without additional compensation, except where prohibited by law.

 

13.     Void where prohibited/restricted by law. Federal, state and local laws and regulation apply.
